Uganda - Suspension and cancellation of Aerodrome certificate

Based on sufficient reason, the Uganda Civil Aviation Authority may suspend the Aerodrome certificate until the certificate holder takes due corrective measures.
- The Authority may suspend aerodrome certificate where—
- a)After a safety inspection or audit, if, it is evident that the applicant/holder of the certificate has not complied with the requirements prescribed in the Authority Regulations and failed to remedy the non-compliance within a period of thirty days after the inspection;
- b)The applicant of aerodrome certificate prevents the Authority from carrying out a safety inspection or audit in accordance with these Regulations;
- c)The holder of the certificate is under receivership, liquidation or bankruptcy proceedings;
- d)Tt is deemed necessary by the Authority, in the interest of aviation safety.
- The Authority may, on giving reasons to the holder of a certificate, suspend the certificate for a period not exceeding sixty days.
- A holder of a certificate who is notified of a suspension in sub regulation (2) may submit a response in writing within fourteen days.
- Not withstanding sub regulation (3), the Authority may suspend any or all of the operations at an aerodrome pending receipt of a response from the holder.
- A holder of a certificate who is aggrieved by the suspension of a certificate may appeal to the Minister against the suspension, within thirty days of the suspension.
- Where an appeal is made under sub regulation (5), the holder of a certificate shall state in writing the reasons why in his or her opinion, the suspension should be varied or set aside.
- The Minister may vary or set aside the suspension made under sub regulation (2) on the basis of the reasons given under sub regulation (6).
- Where a holder of a certificate does not appeal against the suspension in accordance with sub regulation (5), the Authority may cancel the certificate, on giving reasons to the holder of the certificate.
- The Authority shall cancel the certificate upon the expiry of the period of notice.
Note
- An operator shall comply with any conditions that may endorsed on a Licence or certificate.
- An operator who contravenes the set regulations, commits an offence and is liable, on conviction, to a fine not exceeding forty eight currency points or to imprisonment for a term not exceeding twenty four months or both.
- A holder of a certificate who wishes to surrender the certificate shall give the Authority not less than sixty days notice in writing, of the intention to surrender the certificate.

Upon making a suspect ion or revocation of the aerodrome certificate the applicant shall submit the Authority following:-
- Two copies of the aerodrome manual;
- Furnish particulars of the charges levied for the use of an aerodrome or the performance of services at the aerodrome;
- Provided the aerodrome safety, security, efficiency and regularity of air navigation reports;
- Approval from any relevant authority;
- Proof of financial capability;
- Particulars of any non-compliance or deviations from the appropriate aerodrome design, operation or equipment standards;
- Particulars of the airspace classification requirements; and charges as prescribed by the Authority in the Aeronautical circular.
- Information Publication (AIP) or the Aeronautical Information Circular (AIC).

ValidityEdit
- A certificate shall be valid for a period of one year, unless the certificate is suspended, cancelled or revoked in accordance with the Regulations of the Authority.

- The aerodrome whose certificate is surrendered, is abandoned or is not maintained in accordance with the conditions of the certificate, the holder of the certificate shall remove, obliterate or modify the prescribed markings referred to in regulation 50 (f).
