Procedure

Based on sufficient reason, the fish inspector may suspend the fish sanitary certificate until the applicant takes due corrective measures.

1. A fish inspector may cancel or refuse to issue a fish sanitary certificate in respect of any consignment or batch of fish or fish products from an establishment if:-
   • the consignment or batch in respect of which the certificate is sought is contaminated with micro-organisms that are potentially injurious to human health or with undesirable chemicals;
   • the establishment has not complied with the sanitary requirements set out in these Rules;
   • the establishment has not complied with its Quality Management Programme;
   • contamination exceeds the relevant national or international standard;
   • packaging and labelling do not comply with these rules; or
   • The establishment has not complied with any other condition prescribed by the Commissioner.
2. Where a fish inspector refuses to issue or cancel a fish sanitary certificate under the ordinance rule, he or she shall communicate the reasons for cancelation/refusing to issue the certificate to the establishment or applicant.
3. A fish inspector may, for the purpose of establishing the safety and quality of the fish or fish product, take samples for analysis in an officially approved laboratory at the cost of the establishment or applicant. If the sample test fails to pass the required standards the fish inspector may cancel or refuse to grant the certificate.
4. Further any applicant is required to comply with the applicable Fish laws of the country. Where an applicant violates the provisions of the Fish rules or regulations or directives issued to implement the same, the appropriate fish organ may suspend the Fish sanitary certificate until the applicant takes due corrective measures.
5. The directorate fisheries may revoke the Fish sanitary certificate where it is ascertained that:-
   • The applicant obtained the certificate fraudulently or by submitting false information or statements;
   • Incentives granted are misused or illegally transferred to another person;
   • The applicant has failed, without good cause, to renew the Fish sanitary certificate in accordance with fish ordinance. In other words, if the applicant did not annually renew his fish sanitary certificate within a month of the expiry of the certificate.

Domestic and foreign investors making investments in fish and fish product for export are eligible for this certificate

Fees

Cancellation of Fish sanitary certificate takes 5 working days and will cost you Ugshs. 20,000.

Validity

Valid until the issues that led to cancellation/refusing are resolved.
