- To obtain permission to cultivate plant yielding narcotics , the applicant shall apply to the Minister of health through National Drug Authority (NDA) in writing in a prescribed form and manner specified by the Authority. find their website on the following link National Drug Authority
- Acts states that no person shall, without the written consent of the Minister, the proof of which shall lie on him or her, cultivate any plant from which a narcotic drug can be extracted.
- Acts provides that the Minister shall, before giving his or her consent under this section, consult with the authority, and he or she may give his or her consent subject to such conditions as he or she may specify.
- Applicants are required to collect and complete the prescribed application form, obtainable from the National Drug Authority(IRA) head office.
- The applicant will have to prepare an application letter requesting for permission to cultivate plant yielding narcotics, addressed to the Director-General of National Drug Authority.
- Submit the completed form in all respect and all the relevant documents to the National Drug Authority who will in turn submit it to minister. Any omission of the supporting documents will render the application process incomplete.
- The Minister shall, before giving his or her consent within a period of less than three months after receipt of a complete application, consult with the National Drug Authority giving his or her consent as he my specify. The Authority shall prepare a detailed report in respect of the application. It shall then for the purpose of considering and making a report on an application, appoint a committee of not less than five members of the Authority which committee shall report its recommendations to the Minister in writing.
- When considering an application for a license to cultivate plant yielding narcotics the applicant shall satisfy itself as to the accessibility status of psychotropic substance and antecedents of the applicant;
- the premises on which any person is carrying out the narcotics business whether it meets all the requirements to carry out any narcotic drugs/plants or functions imposed on them.
- whether an inspector or assistant inspector of drugs may enter at any reasonable time, any premises on which a business relating to the manufacture or supply of narcotic drugs is carried on.
- and whether the public interest would be protected after granting a license.
- After considering the application then Pay a non- refundable license fee of(708, 536) to the National Drug Authority (Licensing) Board.
- The Authority shall then consider an application and inform the applicant of its decision within 21 days after the application has been lodged and where further information is required, the 21 days period begins to run from the date of the submission of the additional information.
- The National Drug Authority may if it is satisfied that the applicant complies with the provisions of the Act, grant a license to the applicant, on the payment of the prescribed fee.
- If an application is refused, the National drug Authority shall communicate its decision to the applicant within 21 days from receipt of a complete application.
- In this case, the applicant may appeal to the Minister within 14 days from the receipt of the communication of the Authority, if aggrieved by the decision of the authority; and the Minister shall make a decision within 14 days from the date of the appeal.
- The license shall be subjected to terms and conditions as the National Drug Authority deem fit. The licensee shall also be subjected to supervision and monitoring by the National Drug Authority.
- A license shall expire at the end of one year from the date of issue and may be renewed on application, in the prescribed form and after payment of the prescribed fees.

- No person shall have in his or her possession without lawful excuse, the proof of which shall lie on him or her, any narcotic drug or psychotropic substance under international control
No person shall—
- smoke opium or Indian hemp or frequent any place used for the smoking of opium or Indian hemp;
- permit premises owned or occupied by him or her to be used by persons smoking opium or Indian hemp; or
- have in his or her possession pipes or other utensils for use in connection with the smoking of opium or Indian hemp

- Acts states that a person contravening a provision of the Act commits an offense and, where no punishment is provided, is liable—
- to a fine not exceeding one million shillings;
- to a withdrawal of the license or permit for a period not exceeding five years;
- to cause the items in contravention to be impounded, forfeited, destroyed or disposed of in a manner prescribed by the Minister;
- to imprisonment not exceeding one year; or
- to any two of the above punishments, and for any subsequent offense under the Act, a person is liable to a fine not exceeding two million shillings or to a term of imprisonment not exceeding five years or to both.
- A person who commits an offense under the Act and no other punishment is provided is liable—
- where the offense relates to class A drugs, to a fine not exceeding two million shillings or to a term of imprisonment not exceeding five years or to both;
- where the offense relates to narcotic drugs or psychotropic substances under international control and is a second or more subsequent offense, to a term of life imprisonment;
- where the offense relates to manufacturing, smoking or having possession of any narcotic drug or psychotropic substance under international control and is a second or more subsequent offense, to a term not exceeding ten years.
- The Minister may, by statutory instrument, make regulations applying subsection (1) to such other narcotic drugs as are specified in the regulations.
