Nova Scotia - Filing an International Patent

Apply In-person (CIPO office)
- To apply for filing an International Patent in person, the applicant has to visit the headquarters of the Canadian Intellectual Property Office.
- Address and contact details of the office can be found in following Contact link
- Initially, the applicant has to prepare an application manually for filing an International Patent.
- The application should contain the applicant’s information, a description of the invention and all other information related to the invention.
- Then, the applicant should complete the Patent Cooperation Treaty Request Application form
- Once completed, the application and the Request form should be submitted along with all the documents listed in the “Required Documents” section of this page, to the relevant official.
- After submission, patent office will process the application and issue an international filing date and application number.
- Then, an international search will be performed by an International Searching Authority to identify whether the proposed invention is patentable and issues a written opinion.
- Followed by this, the contents of the application will be published along with an international search report, after 18 months.
- Subsequently, the applicant will have to choose a course that they wish to choose, which is called chapter designation process.
- Then, national phase of examination will begin in which the applicant should seek patent protection from the national or regional intellectual property offices of the states that they designated and elected during the application process.
- The amount of fees will be determined by the receiving office and International Preliminary Examining Authorities (IPEAs) with respect to the complexity of the application.
- The applicant can pay the fees through Credit card, WIPO account, Paypal, online banking or postal money order (only within Europe).
- Within the stipulated period of time, once the patent is ready, the applicant will be informed to collect it through any of the applicable means.

- To apply for filing an International Patent in person, the applicant has to visit the foreign patent office in their country.

International Bureau as the receiving office
- To file an International patent online with International Bureau as receiving office, the applicant has to visit the following Apply online
- Visit the link and click “Create WIPO Account” button to create a new account. Complete the account creation page with all the required details and click “Create a WIPO Account” button.
- A confirmation link will be sent to the provided email address. The applicant should open it and click “Validate WIPO Account” button.
- The account will be validated and the applicant will be redirected to the login page. Login using the user credentials and proceed.
- The applicant should click “Menu” which is on the top of the screen and click “Patents” option.
- Then, they can proceed to prepare an International application, file it and manage it by clicking the applicable buttons and following the on screen instructions.
- They can also pay the required fees by accessing the “Pay” option. After submission, patent office will process the application and issue an international filing date and application number.
- Then, an international search will be performed by an International Searching Authority to identify whether the proposed invention is patentable and issues a written opinion.
- Followed by this, the contents of the application will be published along with an international search report, after 18 months.
- Subsequently, the applicant will have to choose a course that they wish to choose, which is called chapter designation process.

CIPO as receiving office
- To file an International patent online with CIPO as receiving office, the applicant has to visit the following Apply online
- Before that, the applicant should complete preparing the International Patent application in the World Intellectual Property Organization portal.
- For that, the applicant should follow the steps in the previous section up to step 6. Then, they should visit the link provided above in this section.
- Visit the link and click the “Log in to PCT e-filing” button. In the next page, two secure login provider links will be available.
- Using GC Key
- a. If the applicant wishes to proceed using GC Key, they should click “GCKey” button and sign in page will be opened.
- b. Enter the user details in the respective fields, then click “Sign In” button, if the applicant already has an account.
- c. If not, click the “Sign Up” button to create an account. Click “I accept” button and type an appropriate username in the next tab.
- d. Click “Continue” button and create a password for the account in the next tab, then click “Continue” button.
- e. Create Recovery Questions, Answers and Hints in the next page and click “Continue” button. Click “I agree” button in the next page.
- f. In the next page, there will be two options to help verify the applicant’s identity. Select an applicable option.
- Using bank account/sign-in partner
- a. If the applicant wishes to proceed using Sign-in partner, they should click “Sign-In Partner” button and sign in page will be opened.
- b. List of financial Sign-In Partners will be displayed in the link, select one among them in which the applicant have subscribed online banking.
- c. Respective online banking portal will be opened, login into it using the user credentials.
- d. After logging in, there will be two options to help verify the applicant’s identity. Select an applicable option.
- Once the applicant has signed in with GC Key and verified his/her identity, the applicant will be directed to create the profile.
- Follow the onscreen instructions and complete the profile creation. Proceed to sign in using the Username and Password.
- After profile creation, get into the portal and locate an applicable option to submit the application prepared in the WIPO portal.
- Follow the onscreen instructions and submit the application package. Also, pay the required fees by clicking the applicable option and following the on screen instructions.
- After submission, patent office will process the application and issue an international filing date and application number.
- Then, an international search will be performed by an International Searching Authority to identify whether the proposed invention is patentable and issues a written opinion.
- Followed by this, the contents of the application will be published along with an international search report, after 18 months.

- The CIPO will consider correspondence sent electronically, including by fax, to be received on the day that it is transmitted, if it is delivered and completely received before midnight, local time at
- CIPO and be accorded that day in office records, irrespective if CIPO is open for business. For any other physical correspondence delivered on a day when CIPO is closed for business, they consider it received on the next day CIPO is open for business.
- Following initial filing, the CIPO advises the applicants to submit any documents or correspondence related to their PCT international application using the general correspondence form Link General correspondence form]
- They can also submit correspondence by regular mail, in person, Canada Post Xpresspost, or facsimile.

- An international patent is required for an inventor to have automatically designated and elected all of the signatory countries to be able to seek patent protection in those countries at the national level.
- The Patent Cooperation Treaty (PCT) is an international treaty administered by the World Intellectual Property Organization (WIPO). Under the PCT system, the inventor may file for a patent in as many as 153 member countries through a single international application filed in Canada.
