  • Across the states in India, the respective state government have appointed competent authorities to ensure enforcement of minerals rules and regulations at district level. The competent authorities were the local panchayat authorities / the local administration authorities / the district collector / the district mining department authority as per the state norms.


Sand Lease Through e-auction

  1. The respective state mining department announces tender notice for the grant of the sand lease (minor mineral quarry) in their official website or using the print media (newspaper). The information can be obtained from the respective office of the assistant director of mines and geology (ADM & G) of their respective district in whose jurisdiction the area falls as appropriate.
  2. The applicant shall visit the following website for details about the tender announcement and also use the contact details provided in the page to get more information in person link AND link1 AND the applicant shall also use the following links to reach the respective district collector office and the panchayat office to get more information link for district please select “About AP > Districts“ menu to get next page. Here please select the respective district from the left part of the screen to get the respective district portal. In this page please select “ABOUT DISTRICT > Who’s Who” for contact details AND Panchayat contact link in the given page please select the hyperlink against respective state as per requirement for contact details.
  3. Please visit the respective office and consult with the designated authority about the bidding requirement. Please obtain the tender document from the authority and pay the applicable document fee.
  4. Complete the tender application form. Attach all the required documents as per the “Required Documents” section of this page, including the documents listed under the "Documents required for participating in the auction" and enclose them in an envelope.
  5. This envelope can be submitted directly at the concerned office as per the authority's advice (in 3 sets) or can be sent through registered post (in 3 sets).
  6. Once the tender application is submitted, the applicant will get an acknowledgement (for postal submission, an acknowledgement will be sent to the address of the applicant by post). Please keep it safe for future reference.
  7. Only those bidders who are found to be eligible shall be processed by the department as per the department’s policy.
  8. Once the department finds the suitable bidder, the preferred bidder will be declared through online portal or as per applicable norms to conclude the auction process.
  9. The State government shall issue a letter of intent to the preferred bidder. The preferred bidder shall be considered to be the “successful bidder” upon:
    1. Payment of one time-bid money, royalty and cess proportionate to the quantity of sand to be extracted.
    2. The winning private bidders are authorized to extract sand as per the mining plan.
    3. Compliance of all the terms & conditions of eligibility.
    4. Obtaining all consents, approvals, permits, no-objections and other relevant approvals for commencement of operations.
  10. Upon fulfilment of the above, the State government grants a sand lease to the successful lessee.
  11. The lessee should strictly follow the notification and guidelines of the department.
  12. The lease period for each sand lease is 5 (five) years, or as per the time period for which the lease is granted.


Apply In-Person:

  1. Based on the announcement or as per the identification of such opportunity, the applicant shall approach the respective office of the assistant director of mines and geology (ADM & G) of their respective district in whose jurisdiction the area falls as appropriate.

  7. Only those bidders who are found to be eligible, whose initial price offer is equal to or greater than the reserve price, shall be considered for the second round of auction.
  8. The highest initial price offer amongst the technically qualified bidders shall be the “floor price” for the second round of auction or online electronic auction.
  9. The technically qualified bidders shall be ranked on the basis of the descending initial price offer submitted by them and the technically qualified bidders holding the first fifty percent of the ranks or the top five technically qualified bidders, whichever is higher, shall qualify as qualified bidders for participating in the second round of auction or electronic auction.
  10. The bidders are eligible to get the hall ticket to participate in the auction.
  11. The shortlisted bidder should pay 25% of the upset price as Earnest Money Deposit to participate in the auction. This amount shall be remitted through Demand Draft drawn in favour of Assistant Director of Mines & Geology concerned.
  12. Once the timeline is fixed for the auction, the auctioning authority will decide on the highest bidder to award the tender.
  13. Once the department finds the suitable bidder with the highest final price, the preferred bidder will be declared to conclude the auction process.
  14. The winner of the bid should furnish performance security (0.25% of the value of estimated resources).
  15. The State government shall issue a letter of intent to the preferred bidder. The preferred bidder shall be considered to be the “successful bidder” upon:
    1. Payment of fees, royalty and cess proportionate to the quantity of sand to be extracted.
    2. Compliance of all the terms & conditions of eligibility.
    3. Obtaining all consents, approvals, permits, no-objections and other relevant approvals for commencement of operations.
  16. Upon fulfilment of the above, the State government grants a sand lease to the successful lessee.
  17. The lessee should strictly follow the notification and guidelines of the department.
  18. The lease period for each sand lease is 5 (five) years, or as per the time period for which the lease is granted.

Documents required for participating in the auction

  • Bid letter in the format specified as per the tender document
  • Bid security in form of a bank guarantee for an amount mentioned in tender document as per requirement
  • In case of bidder being a company, a power of attorney (notarized) in the format specified in the tender document authorizing the signatory
  • An affidavit (notarized) in the format specified in the tender document as per requirement
  • In case of bidder being a company, duly certified copy of the corporate authorization (notarized), such as board resolution to participate in the tender process and submit a bid
  • Notarized copy of PAN card of company and PAN card of authorized signatory
  • No dues certificate, which shall not be older than 6 months, from the respective mining engineer / AME
  • Memorandum of articles & certificate of incorporation if the bidder is a company & partnership deed & firm registration certificate if bidder is a firm
  • The copy of GST receipt paid by bidder on purchase of tender doc

  • A firm (registered under government of India).
  • The area marked for sand winning should have the clearance from the forest department or public work department or geology department as per the land jurisdiction.

InstructionsEdit

  • If the proposed mining area lies within a distance of 45 meters (or as per the distance mentioned) from the railway line, previous written permission of the railway administration is required.
  • The state government’s enforcement wing officials shall have the power to file a complaint in case of pilferage, illegal mining, illegal transportation, misuse of sand, violation of environmental regulations and other such illegal and irregular activities.
  • No extraction of minerals shall be made from any public place or 50 meter from such public places.
  • To prevent illegal extraction and transportation of minerals, the respective state department have laid down strict provisions.
  • No mining lease shall be granted by the state government unless it is satisfied that, there is a mining plan duly approved by the central government or by the state government, in respect of such category of mines as may be specified by the central government, for the development of mineral deposits in the area concerned.
  • Incomplete application will be rejected.
  • Avoid spelling mistakes while filling the application form.
  • At any stage, if the document submitted by the applicant is found to be false, then the licence/lease issued shall be liable to be cancelled.

Need for the DocumentEdit

  • The “Sand Mining Lease" or sand licence means a lease granted by the respective State Government (through the governing body) for the purpose of undertaking river sand mining (winning river sand).
  • The main objective of the sand lease is to ensure that sand mining is done in a scientific, environmentally sustainable and socially responsible manner. Thus, the damage to the riverine ecology, groundwater depletion and flooding can be prevented.
  • The sand lease is aimed at addressing the issue of indiscriminate mining of sand, black-marketing, artificial supply shortage through hoarding and to ensure compliance with environmental regulation and affordable pricing for the end consumers.
  • No person shall undertake any mining operations in any area, except under and in accordance with the terms and conditions of a mining lease, granted as per the act and the rules made thereunder.
