Alberta - Transferring Ownership of Your Trademark

Apply In-Person:
- To transfer ownership of a trademark in person, the applicant has to visit the Canadian Intellectual Property Office.
- The address and contact details of the office can be found in the following Contact link
- The applicant has to visit the office and approach the relevant official who is responsible of receiving ownership transfer applications.
- The official will instruct the applicant about what he/she should do to transfer the ownership.
- The applicant has to follow the instructions of the official and provide the information/details demanded by the official.
- Generally, the office requires the name of the transferee and his/her postal address to complete the process.
- Then, the applicant should submit the required documents listed in the “Required Documents” section of this page and pay the required fees of 100 dollars through Debit/credit card or direct cash.
- On receiving the application form, the official in-charge will go through the application to make sure if it is complete. Then, the Department will proceed to review and assess the submitted information.
- On completion of the review, the office will inform the applicant through phone number or email to collect the modified Registration Certificate.

- Any owner of a registered trademark, who wishes to transfer his/her ownership to another person, can apply.
- A person, who receives the ownership (transferee) from the previous owner, can also apply.
- Any person, who has been authorized by the owner to apply for the transfer, can also apply.

InstructionsEdit
- There is no requirement to provide the Trademarks Office with the original of any document that is provided as evidence of a transfer. The Office will accept copies of documents or of relevant excerpts from transfer documents.
- The applicant or registered owner can be represented by another person authorized by them, whether or not that person is a trademark agent, to make a request or provide evidence of a transfer.

- Registered Trademark owners must formally notify the Registrar when they are selling, handing down or transferring their rights to someone else through an assignment. This helps in avoiding ownership disagreements.
