West Bengal - Obtain Contract Labour Licence for Contractor

Procedure

Apply Online - The online procedure is on hold. Those who wanted to apply for this license should get the “Form V” from the principle employer

To obtain contract labour licence for contractor, the applicant has to use the following link
In the given page applicant has to click “Apply” button under “Licensing for Contractors” option
Applicant will get a popup to select the online process from the given list. Please select “Labour Commissionerate” option to reach next page.
Please go through the instructions and click “I AGREE” button to reach login page.
Applicant has to enter the user name, password, captcha as appropriate and click “LOG IN” button to login.
If you are a new user then use the “New Registration” option and follow the registration page prompts and section to complete the registration process and then login.
Once login, applicant will reach dashboard.
From the list of services, applicant can select the applicable option for Contract labour license.
Applicant will get online application form. Please fill in all the relevant details as per page prompts
Upload required documents as per the prompt.
Upon submission, the applicant will confirm payment of fees by clicking on the applicable button
Pay necessary fee using payment gateway or by selecting challan to pay over the respective counter.
Finally submit the application online using applicable button.
A system generated acknowledgement will be provided. Please save it for future reference.
An SMS alert will be sent to the applicant regarding application submission.
Application will be forwarded online to the concerned department.
After scrutiny by the designated authority, short fall in the documentation if any will be intimated through SMS along with the date of inspection.
Department authorities will verify the documents, Inspect the premises and clarify their queries.
The Application along with report will be forwarded to the issuing authority concerned.
If the applications is found to be correct, applicant will get notification about the sanction through SMS in their registered mobile number.
This certificate shall be hand delivered or sent through post as per applicable norms.

Note:

Make sure to keep the “First-Aid Facilities” in the premises during inspection.
It is advised to submit additional set of copy of the documents and get counter signed for your safety while applying with government department.

Apply In-Person:

Applicant shall apply with their respective labor office of the registering officer of the area in which the establishment sought to be registered is located.

Go to the respective office and consult with the concerned authority for your requirement and collect the latest updated details and documents required.
The applicant shall collect the respective application form.
Please arrange the documents including the “Form V’ from the principle employer for whom the contractor is providing service.
Once the check list of information is ready, prepare all the requirements as guided. Complete the application form. Attach the required documents. Please refer our required document section.
Submit or post as per advised mode, the completed application form along with required documents and prescribed fees as applicable to the designated authority.
Submitted application will be verified by the authorities. If all are in place, applicant will be provided with acknowledgement for the submitted application.
This application will be processed internally.
The applicant gets notification about the process through their registered mobile number.
Department authorities will verify the documents, Inspect the premises and clarify their queries.
If the application is found to be correct in all respect, then a Contract Labour License is issued to the applicant.
This certificate shall be hand delivered or sent through post as per applicable norms.

Work Order

The original copies of the Treasury Challan depositing the requisite amount of fees as security and the license fees in the specified Head of Account in the Govt. treasury or through the "e-Payment" when it is notified and functioning as per norms.
No objection certificate from police department/Police Report.
Copy of the agreement between the Principal Employer & Contractor.

Eligibility

If the entrepreneur/applicant engages 50 (please follow authorities advise) or more contractual workers in the contractual work are eligible
An Individual or a firm shall apply
Applicant should be a major
Applicant should not be convicted (at any time during a period of five years immediately preceding the date of application)

Fees

Security deposit as advised by authorities for each workman to be employed as contract labour shall be deposited.

Validity

Every licence granted is valid for twelve months from the date it is granted.

Processing Time

This license will be processed in 15 days from the date of receipt of completed application form.

Instructions

The licence is non-transferable.
The number of workmen employed as contract labour in the establishment shall not on any day, exceed the mentioned numbers as per application.
The fees paid for the grant of the licence shall be non-refundable.
The rates of wages payable to the workmen by the contractor shall not be less than the rates prescribed for the schedule of employment under the Minimum Wages Act, 1948, where applicable, and where the rates have been fixed by agreement/ settlement or award, not less than the rates fixed.

Need for the Document

This license is required for the employment of contract labour in certain establishment.
To every contractor who employs or who employed on any day of the preceding twelve months ten or more workmen then they need to get this license.
In order to bid for the government work where the labour license is pre requisite, then the firm need to obtain this license.

Every certificate of registration granted shall contain the following particulars, namely-

- The maximum number of workmen to be employed as contract labour in the establishment
- The type of business, trade, industry manufacture or occupation which is carried on in the establishment;
