Procedure

Where to register the marriage dissolution:

• At the place of the spouses' residence or residence of either one of them.
• Office of state registration of civil status acts will raise no objection, if one of spouses filed an application for state registration of marriage dissolution with the office of state registration of civil status acts not at his/her place of residence, but at the place of the other spouses residence. In this case, the place of residence of the other of spouses is confirmed by his/her passport or passport document with the record on his/her residence or a relevant paper issued by competent bodies (item 5, Chapter 3, Section ??? of the Rules of state registration of civil status acts in Ukraine).
• In case one of spouses is declared missing or legally incompetent in accordance with the prescribed procedure, the state registration of marriage dissolution is conducted at the place of the other spouses residence upon his/her application for marriage dissolution.

Entry made in the passports or passport documents of the spouses after dissolution of marriage:

• An entry on registration of marriage dissolution is made in the passports or passport documents of persons, whose marriage is dissolved, specifying the place and time of such registration, family name, first name and patronymic of a person, who dissolved marriage, family names after registration.
• If state registration of marriage dissolution was conducted in the absence of one of spouses, an entry on marriage dissolution in his/her passport or passport document is made when delivering him/her the Marriage Dissolution Certificate by the office of state registration of civil status acts issuing the certificate, with indication of the actual place and date of state registration of marriage dissolution.
• An entry on marriage dissolution on the basis of courts decision is made in passports or passport documents of persons, whose marriage is dissolved, in case of their addressing to the office of state registration of civil status acts and presenting the courts decition.

Required Documents

Dissolution of Marriage Granted by the Court:

• Written application for state registration of marriage dissolution on the ground of courts decision
• Copy of effective courts decision (an extract from courts decision) on marriage dissolution
• Passport or passport document
• Receipt evidencing payment of the state duty established by the court
• If one of spouses, due to a valid excuse, cannot arrive for state registration of marriage dissolution, he/she can, when submitting an application for registration of marriage dissolution or within one month, notify in writing the body of state registration of civil status acts on consent to registration of marriage dissolution at his/her absence, and indicate the location of the body of state registration of civil status acts, where the Marriage Dissolution Certificate should be forwarded to. In case of sending a written notification, the signature affixed thereon of the spouse, who cannot arrive, should be notarized.

Application for marriage dissolution of spouses, who do not have children:

• Written application for dissolution of the marriage of spouses, who do not have children, with the indication of the fact on non-existence of children.
• The Marriage Certificate must be attached to the application

For dissolution of marriage on the ground that one of spouses is declared missing or legally incompetent:

• Written application
• The initiator of marriage dissolution must also enclose a copy of courts decision (an extract from courts decision) on declaration of the other of spouses missing or legally incompetent.

Need for the Document

Dissolution of marriage or divorce is the termination of marital union between married couple. It results in cancellation of all legal duties and responsibilities between husband and wife.

There are two ways in which marriages are dissolved in Ukraine, first is by the Body of State Registration of Civil Status Acts and second through a Court Procedure. Once the authorities has granted the petition for the dissolution of marriage and a Certificate on Marriage Dissolution it must be registered with the State Registers.
