ProcedureEdit

  1. An agency or applicant shall submit an application for the renewal of its Permit on or before the expiration of the Permit.Such application shall be supported by the following documents.
    • A Renewed Bank guarantee with a face value of the amount of Uganda Shillings fifty million (USh50,000,000/=) with a commercial bank to primarily answer for the valid and legal claims of recruited Ugandan migrant workers as a result of recruitment violations or money claims.
    • An Audited financial statement reports for the past one (1) year with verified corporate or individual tax returns.
    • In case the equity of the agency is below the minimum capitalization requirement, it shall be given thirty (30) days from release of the renewed license to submit proof(s) of capital infusion.
    • Otherwise the license shall be suspended until it has complied with said requirement;
    • A Clearance report from the CID and Anti-Illegal Recruitment Branch for all its employees and officers; and
    • Other requirements as may be imposed by the Administration.
  2. The application for recruitment renewal shall be submitted to the commissioner of labour in the ministry of Gender Labour and social development accompanied with the renewal prescribed fees of 500,000/= deposited in the a commercial bank.
  3. The commissioner for Labour may grant a permit with or without conditions.
  4. A permit issued shall be valid from the date of issue of the year in which it is issued and if the permit holder has made timely and sufficient application for renewal, the existing license shall not expire until the application has been finally determined by the administration. For this purpose, an application shall be considered sufficient if the applicant has complied with the requirements for renewal
  5. Where the commissioner for labour refuses to grant a permit the commissioner for Labour shall, within thirty days, inform the applicant of its refusal to grant the permit and the reasons for the refusal.

Required DocumentsEdit

  • Applicant must be registered under the companies Act or Partnership Act of Uganda.
  • If partnership half of the partners must be Ugandans citizens.
  • The partnership or company must have a minimum of fifty million Uganda shillings as share capital.
  • Must have a maintaining balance of Shs.10milion on the bank account (Bank statement).
  • The applicant must not be engaging in business of a travel agency or sales agency of an airline company.
  • The applicant must not be a political, religious or tribal organization.
  • The applicant must show proof of international connections that will enable them place Uganda migrant workers.
  • Members of board and officers of the company must have clearance letters by the Uganda Criminal Investigations Department - Certificate of good conduct from Interpol.
  • Must provide verified financial statement, income tax returns for the preceding two years.
  • Must provide the CVs of directors, board members and officers working in the company or partnership.
  • Must submit proof of publication of notice in the newspapers of the application with the names of the partners, incorporators and officers.
  • Must provide a bank guarantee of 50,000,000 Ugx.

EligibilityEdit

  • Ugandan citizens, partnerships or companies at least seventy five percent (75%) of the authorized and voting capital stock of which 51% is owned and controlled by Ugandan citizens.
  • A minimum capitalization of Uganda Shillings one hundred million (USh100, 000,000/=) in case of a partnership and a minimum paid-up capital of Uganda. Shillings one hundred million (USh100,000,000/=) in case of a company; and
  • Those not otherwise disqualified by law or other government regulations to engage in the recruitment and placement of Ugandan migrant workers.

  • Renewal for internal recruitment agency – 200,000 Ugx

ValidityEdit

Validity: 2 Years for external recruitment agency and 1 year for internal recruitment agency.

InstructionsEdit

  • Any agency which failed to file an application for renewal of license may be allowed to renew within thirty (30) calendar days from expiry thereof and subject to the payment of a fine of Uganda Shillings two hundred thousand(UShs 200,000/=).
  • Action on Renewal of Licence: Within forty-eight (48) hours from receipt of the application for the renewal with the complete requirements, the Administration shall undertake evaluation and inspection and determine the grant or denial of the application.
  • Application for renewal of license, which fails to meet the requirements set by the Administration, shall be denied

  • The Administration shall monitor the compliance of agencies with their undertakings in connection with the issuance or renewal of the licence.
  • Appropriate sanctions shall be imposed for non-compliance with any of their undertaking.
