ProcedureEdit

Any person having a claim or interest in land or right of occupancy,which is subject of a transaction, may lodge a caveat in Form 37 as specified in the Schedule of the Regulations.
Step 1
The Applicant must have in his/her possession two sets of embossed caveat documents duly witnessed by an Advocate signed by the person who is placing the caveat (Deponent) and dated, Statutory Declaration signed by the Deponent & a Commissioner for Oaths and two Passport photographs of the person placing the Caveat.
Step 2
The Applicant presents the full set of original documents and a photocopy of the same, to Department of Land Registration for processing. The Photocopy is stamped ‘Received’ and returned to the Applicant. The Applicant checks with the Department of Land Registration after 10 working days to confirm entry of the caveat upon the register.

EligibilityEdit

  • Any person, company, organization or institution having a claim or interest in land or right of occupancy, which is subject of a transaction, may lodge a caveat to prevent any transfer, sell, exchange, pledge, mortgage, lease or change in ownership or any transaction affecting the land or right of occupancy.

FeesEdit

  • Stamp duty- 20,000
  • Registration fees –10,000

  • Valid for specific period of time stated or till the interest of the beneficially is taken care of

InstructionsEdit

  • No dealing in land should be done where there is in force a caveat forbidding the same.
  • It is prudent for one who is unable to complete payment to lodge a caveat to prevent another person from obtaining the interest It is trite law that a transfer effected while a caveat is in force is void and ineffectual to pass title.
  • If it is to be removed, the beneficiary has to be given notice and consents to the same.
  • Fees and stamp duty are payable. It must be accompanied by a statutory declaration giving reasons why the caveat is being lodged.

Information which might helpEdit

  • A lawful occupant can also lodge a caveat to protect his interest.
  • A lawful occupant is a person occupying land by virtue of the busullo, envujjo laws or the Toro Ankole land and tenant laws. Or a person who has entered the land with the consent of the registered owner or a person in occupation of customary tenure but whose tenancy was not disclosed or compensated by the registered owner.
  • When a beneficiary lodges a caveat, that caveat does not elapse until the interest of the beneficiary is taken care of.
  • The recorder shall not accept the caveat unless the Caveator has made a declaration in Form 37 specified in the Regulations, verifying the truth of a claim stated in the caveat.
