ProcedureEdit

The Night club/Dance Hall Permit/License are transferable, and they can be issued to either an individual or a company.

  1. To apply for Night club/ Dance Hall License or Permit the applicant has to contact the Municipal council Authority/Town/City office near your Location.
  2. The Completed application forms should be submitted along with appropriate documents as prescribed by the Authority to the Town clerk office.
  3. The next step is the inspector officer from the Authority to inspect the Night club/Dance Hall before the permit is approved. The following must be inspected before the Authority approves the application.
    • Noise Abatement
    • Dept. of Building Inspection
      • Electrical Inspector
      • Plumbing Inspector
      • Building Inspector (structural)
    • Fire Inspector
    • Health Inspector
    • Planning (zoning)
  4. If applicant is successful on the inspection steps, the applicant will be issued with bank slips to pay appropriate License fees in bank as prescribed by the Authority.
  5. Once the application is submitted with appropriate fees the application is processed and the Licence/Permit is granted.

Note: If you are granted permits with unacceptable stipulations attached, you have the right to file an appeal within 15 days.

  • Applicant should obtain Clearance from Ministry of Trade, Industry and Cooperatives for non-nationals.
  • For new business - original certificate of registration (Business name)
  • Certificate of incorporation for a (Company)
  • Applicant should obtain clearance from Uganda Registration Services Bureau.
  • Original municipality receipt for the previous year indicating existing business
  • Original rent and tenancy agreement from the Land lord for the new business.
  • Original trading License for the previous year for already existing business.

EligibilityEdit

Any person of 18 years carrying out business in Municipality/Division/Town/City/Kampala City Council Authority’s jurisdiction except those who are exempted under Section 8(2) of the Trade Licensing Act are eligible to obtain Trading license to operate a night Club /disco dance hall.

FeesEdit

The founder must pay the relevant license fee at the bank, as follows:
License Fee:

  • (a) Grade I - 187,500 Ugsh
  • (b) Grade II - 112,500 Ugsh
  • (c) Grade III - 75,000 Ugsh
  • (d) Grade IV - 45,000 Ugsh

Renewal Fee:

  • (a) Grade I - 187,500 Ugsh
  • (b) Grade II - 112,500 Ugsh
  • (c) Grade III - 75,000 Ugsh
  • (d) Grade IV - 45,000 Ugsh

InstructionsEdit

  • You need to have Dance Hall permit if you want to allow people to dance.Also note that the Dance Hall permit only allows dancing until 12:00 Midnight unless one get a special permission from the Authority.
  • Though the Night Club Permit /Licence allows people to remain in the club, it does not automatically allow dancing that is why they are issued together.(Nightclub/Dance Hall Permit/Licence).

  • Legal Status of the Applicant
  • List and Particulars of Shareholders;( if any)
  • Certificate of Registration,
  • Certificate of Incorporation,
  • Memorandum and Articles of Association
  • Deed of Partnership,
  • Deed of Trust, as applicable
  • Information if the shareholder has ever been convicted of a criminal offence in Uganda or in any other country.
  • List and Particulars of Directors.
  • information if you have ever acquired a Licence and state the nature of the Licence, date issued and the Licence number.

Information which might helpEdit

  • If you own a business (a bar, a restaurant, whatever) and some of your customers get up and start dancing, then you're breaking the law if you don't have one of Night Club/Dance Hall permits.
  • The State permit is transferable, and can be issued to a company instead of an individual, but the City permits are effectively non-transferable, and can only be issued to an individual (not a company). If you have one of these permits, and you want to sell your business, the buyer has to apply for their own instance of this permit.
  • For the purposes of determining the fees payable in any city, municipality or town, the Minister shall, by statutory order, divide the area of any city, municipality or town into grades.
    • Grade I areas to comprise all industrial areas in the Municipality and District.
    • Grade II areas to comprise all areas outside Grade I areas in the Municipality.
    • Grade III areas comprise in the trading centres- in a District.
    • Grade IV areas that comprise outside the trading centres in the District.
