Procedure

Apply In-Person

1. Application for Tobacco Buying license is done in person by visiting the commissioner for Tobacco control in the Ministry of Agriculture and fisheries Head Offices.You can visit their website on the following link
   
2. Here you will be issued with an Application for Tobacco buying license – form to fill and submit.
3. Fill in the required information and attached the required documents.
4. Submit the completed application form and pay the required application fee of Ugshs. 690,583 and submit the receipt as proof of payment.
5. This is followed by verification of Tobacco growing area by the commissioner for Tobacco control from the Ministry of Agriculture and Fisheries.
6. Recommendations based in findings of the investigation will be made to the Crops inspection officer(s) for final Authority approval.
7. At this point, the applicant is notified if the applicant has been successfully accepted to buy Tobacco or which rectifications have to be made in order for Applicant to buy Tobacco.
8. Upon a successful approval, the applicant is notified and he/she will be required to pay for the license to buy Tobacco at Ministry and submit the receipt as proof of payment.

Required Documents

• Identification Cards/ Passport and PIN Number of the applicant is required
• Duly filled application form required
• A Licensed for growing area of tobacco.
• Area of land where Tobacco is to be grown.
• Proof of payment of registration fees.
• Any other requirements that may be prescribed by the commissioner from time to time
• Registration certificate (in case of Organization/ Cooperative Society / Company)
• Copy of title deed or certificate of leasehold of duration of lease of not less than six years as proof of ownership or proprietorship and a current certificate of search or other supporting documents.
• Clearance by Ministry of Agriculture and fisheries Tobacco control department. (if applicable)
• Proof of a minimum of 2 acres of Tobacco or 20,000kgs of leaves on an average of three years.
• Any other requirements that may be prescribed by the Authority from time to time

Eligibility

• Any person who wishes to buy tobacco for sale in an area declared to be a growing area is Eligible for registration as a grower in accordance with regulations made for that purpose.

Fees

• The License Fees required to buy Tobacco is Ush.690,583.

Validity

• The license shall be valid only for the buying season

Instructions

• No person shall buy tobacco unless he or she has a valid license issued by the Minister.
• License should not be transferrable except with the written permission from relevant Authority.
• Any person who buys tobacco without a license commits and offence and is liable on conviction to an imprisonment term not exceeding six months or to a fine not exceeding two hundred and fifty pounds or both.

Need for the Document

• In order to protect the public, Tobacco buyers are mandated by law to apply for a permission in order to protect the users from dangers arising from excessive use of Tobacco , the Ministry of agriculture animal industry and fisheries requires that anybody who intends to buy Tobacco should be licensed .
• The purpose of this document is to satisfy that the applicant meets the requirements necessary to carry out tobacco buying and processing activities before a license is issued.

• In addition, the Minister shall, before each buying season, publish the number of licenses, which may be used in respect of each tobacco market.

Note:Minister has the powers to issue a tobacco-buying license under the Act, but under the regulations, the registration of persons who buy tobacco is done by the Commissioner.
