ProcedureEdit

  1. To register a patent, you must check first if your invention can be patented - Patents Act.
  2. Begin your application by submitting an application for registration. You will need to disclose in your application how the invention was created in a manner which is clear and complete enough for the invention to be performed by a person skilled in the art, and shall, in particular, indicate at least one mode known to the applicant for carrying out the invention.
  3. Pay the application fee.
  4. Your application will be examined to see if it is in accordance with the Patents Act. Applicants will be given a chance to rectify their application to meet the requirements set by the Act.

Required DocumentsEdit

  • Completed application. The specification of an application shall disclose the invention in a manner which is clear and complete enough for the invention to be performed by a person skilled in the art, and shall, in particular, indicate at least one mode known to the applicant for carrying out the invention.
  • A specification containing a description of the invention, a claim or claims and any drawings referred to in the description or any claim
  • An abstract
  • Where the applicant’s ordinary residence or principal place of business is outside of Trinidad and Tobago, an address within Trinidad and Tobago for service; and
  • Where the applicant is not the sole inventor or the applicants are not the joint inventors, a statement justifying his or their right to be granted the patent

EligibilityEdit

Patents can be filed for inventions in most areas of science and technology but some areas are excluded from patentability. These are:

  • Ideas, hypotheses, discoveries (of things already existing in nature), scientific theories and mathematical methods.
  • Rules of games, lottery systems, methods for performing mental acts, teaching methods and organizational procedures.
  • Diagnostic, therapeutic and surgical methods used on the human and animal body.
  • Literary, dramatic, musical or artistic works or any aesthetic creation whatsoever.
  • The presentation of information.
  • Inventions, the exploitation of which would be contrary to public order or morality, also cannot be patented.


For an invention to be patented, it must:

  • Be novel (new), nothing like it in existence in the world or in the literature, including other patent documents;
  • Exhibit a sufficient “inventive step” (be non-obvious to someone with average skill in the art); and
  • Industrially applicable, have a technical effect (be useful). In short, it must work and comply with the laws of nature.

The IPO is a department within the Ministry of Legal Affairs. The department is the local government agency responsible for handling the registration and conflict resolution of intellectual property rights.


What is a patent?

A Patent is an exclusive right granted for an invention, which is a product or a process that either provides a new way of doing something, or offers a new technical solution to a problem. The patent protects the invention, preventing others from manufacturing, using and trading it. The owner is required to disclose technical information to the public sufficient for persons with average skill in the art to manufacture and use the technology.
