Apply In-Person

  1. A person desirous of becoming a Patent Agent must pass the Patent Agent Exam conducted by the Office of the Controller General of Patents, Designs & Trade Marks under the Indian Patents Office. Contact details: link
  2. Interested candidates can apply through the website link
  3. The application tab for the exam will be made active once the announcement of the exam is made.
  4. Once the candidate clears the exam with 60% aggregate, they must submit Form 22 to the Controller General of Patents in the Patents office.
  5. The state of Uttar Pradesh comes under the New Delhi office’s jurisdiction link
  6. The application form should be furnished along with other documents required. The application form is available in the Patent office.
  7. The documents to be attached that are mentioned in the “Required Documents” section of this page.
  8. The candidate shall pay the fee mentioned by the office and submit the receipt to the Controller General of Patents in the Patent office.
  9. After verification, the candidate is registered as a Patent Agent, and the details concerned will be entered in the Indian Patent Agent register.
  10. The Controller will issue a certificate to acknowledge the registration.
  11. The candidate can collect the certificate from the Patent Office.



Apply Online:
Step – 1

  1. To register as Patent Agent, the applicant has to use the following link – link
  2. Select “Register (New Applicant)” option available at Login Page for new registration. The ‘Applicant Registration Form’ contains details.
  3. After filing all details click on “Submit” button.
  4. The applicant gets the user ID and the applicant ID in SMS and email.
  5. Login to the account with the valid account details, the applicant will get the following Patent Agent Examination-2020(2022) Main Menu.


Step – 2 Application form

  1. Select the “Application Form” option from the ‘Main Menu’ and you will get the following screen. Enter the relevant details in the form.
  2. Click on “Upload Photograph” button for uploading the photograph. The maximum file size of applicant photograph should not exceed 300 KB and must be in JPG format.
  3. Click on “Upload Signature” button for uploading the signature in. The maximum file size of applicant signature should not exceed 300 KB and must be in JPG format only.
  4. Use Upload button to upload all the three mandatory documents i.e. Proof of Age, Degree Certificate and Proof of Citizenship in PDF format only.
  5. During making entries, the applicant can save the draft data at any moment of time by using “Save Draft”.
  6. Applicant cannot change the data after “Final Submit”.
  7. Final Submit button would be enabled only after selection of “Declaration Check Box” button and submission of all the mandatory information like Evidence of Nationality, Examination Centre, Applicant Photograph, Applicant Signature and other mandatory documents.
  8. Preview the application form and make a payment in the online mode.


Step – 3 Fee

NOTE: The payment can be made by a depositor using all Indian Credit Cards or Debit Cards (except Diners Club Card) and also via the Internet Banking of banks through the any Payment Gateways available below. The payment via American Express Credit Card (AMEX) can be made through SBI ePay payment gateway.
  1. Select any one of the seven gateways for the payment.
  2. Click on any one of the mentioned payment method- Net banking/Debit card/Credit Card/UPI.
  3. Enter the Captcha.
  4. Click on the check box regarding terms and conditions.
  5. Click on the ‘Pay’ button.
  6. After completing take a print of receipt.


Step – 4 Print an admit card

  1. The admit card can be download once the notification gets from the office.

  • Copy of proof of degree
  • Admit card signed by the candidate along with invigilator’s signature
  • Two passport size photographs.

EligibilityEdit

The eligibility criteria for Patent Agent Exam is as follows:

  • Indian Citizenship
  • Age must be above 21
  • Must have a degree in science, engineering, or technology from any University established under law.


The eligibility criteria for Patent Agent registration

  • Candidate with a 60% overall score from the Patent Agent Exam.

InstructionsEdit

According to rule 114, the authorities can disqualify a candidates registration as a Patent Agent:

  • If he/she is declared by a competent court to be of unsound mind.
  • If he/she is an undischarged insolvent.
  • In case of a discharged Insolvent, he/she has failed to obtain from the court a certificate to the effect that his/her insolvency was caused by misfortune and not due to any misconduct on his/her part.
  • If he/she is convicted by any court, whether within or outside India, to undergo a term of imprisonment unless,
  • He/she is pardoned for the offense committed.
  • On an application made by him/her, the Central Government has, by order on this behalf, removed the disability.
  • If being a legal practitioner he/she is found guilty of professional misconduct.
  • If being a chartered accountant, he/she has been guilty of negligence or misconduct.
